Notice of Privacy Practices for Peptide Wellness

Who We Are

This Notice describes the privacy practices of Peptide Wellness and its affiliates, including physicians, healthcare practitioners, and other personnel (“we” or “us”).

Our Privacy Obligations

We are required by law to maintain the privacy of your health information (“Protected Health Information” or “PHI”) and to provide you with this Notice of our legal duties and privacy practices. We must notify you following a Breach of unsecured PHI. We are required to abide by the terms of this Notice.

III. Permissible Uses and Disclosures Without Your Written Authorization

We do not need your authorization for the following uses and disclosures:

Uses and Disclosures for Treatment, Payment, and Health Care Operations

Treatment: We may use and disclose your PHI to provide treatment, such as diagnosing and treating your illness. We may disclose PHI to other healthcare providers involved in your treatment.

Payment: We may use and disclose your PHI to obtain payment for services provided.

Healthcare Operations: We may use and disclose your PHI for internal administration, planning, and activities to improve the quality and cost-effectiveness of the care we deliver.

Disclosure to Relatives, Close Friends, and Other Caregivers

We may disclose your PHI to family members, other relatives, or close personal friends involved in your care if you agree or do not object, or if we infer from the circumstances that you do not object. If you are not present or in an emergency, we may exercise professional judgment to determine if disclosure is in your best interest.

Public Health Activities

We may disclose your PHI for public health activities such as controlling disease, reporting child abuse or neglect, and reporting to the FDA.

Victims of Abuse, Neglect, or Domestic Violence

If we believe you are a victim of abuse, neglect, or domestic violence, we may disclose your PHI to a governmental authority authorized by law to receive such reports.

Health Oversight Activities

We may disclose your PHI to health oversight agencies responsible for ensuring compliance with government health programs like Medicare or Medicaid.

Judicial and Administrative Proceedings

We may disclose your PHI in response to a legal order or other lawful processes during judicial or administrative proceedings.

Law Enforcement Officers

We may disclose your PHI to law enforcement officials as required or permitted by law.

Decedents

We may disclose your PHI to a coroner, medical examiner, or funeral director as authorized by law.

Research

We may use or disclose your PHI for research purposes if approved by an Institutional Review Board or Privacy Board.

Health or Safety

We may disclose your PHI to prevent a serious and imminent threat to a person’s or the public’s health or safety.

Specialized Government Functions

We may disclose your PHI to government units with special functions, like the U.S. military or the U.S. Department of State.

Workers’ Compensation

We may disclose your PHI to comply with state laws relating to workers’ compensation.

As Required By Law

We may use and disclose your PHI as required by law.

Uses and Disclosures Requiring Your Written Authorization

Use or Disclosure with Your Authorization

We must obtain your written authorization for uses and disclosures of PHI for marketing purposes and disclosures that constitute the sale of PHI. Other uses and disclosures not described in this Notice will only be made with your written permission.

Uses and Disclosures of Your Highly Confidential Information

Federal and state law requires special privacy protections for certain highly confidential information about you. This includes information about mental health, alcohol and drug abuse, HIV/AIDS, sexually transmitted diseases, genetic testing, child abuse, domestic abuse, and sexual assault.

Revocation of Your Authorization

You may revoke your authorization at any time by delivering a written statement to the Privacy Officer.

Your Rights Regarding Your Protected Health Information

For Further Information and Complaints

You may contact our Compliance and Privacy Officer for more information about your privacy rights or to make a complaint. You can also file a complaint with the Director, Office for Civil Rights of the U.S. Department of Health and Human Services.

Right to Request Additional Restrictions

You have the right to request restrictions on the use and disclosure of your PHI. We are required to comply with requests to restrict disclosures to a health plan if the disclosure is for payment or healthcare operations and the PHI pertains solely to an item or service paid out of pocket in full. Other requests are not required to be agreed to, but we will attempt to accommodate reasonable requests.

Right to Receive Confidential Communications

You may request to receive your PHI by alternative means or at alternative locations. We will accommodate reasonable requests.

Right to Inspect and Copy Your Health Information

You may request access to inspect and copy your medical and billing records. Requests must be submitted to the Privacy Officer. We may charge a cost-based fee for copies.

Right to Request to Amend Your Records

You have the right to request an amendment to your PHI. Submit requests to the Privacy Officer. We may deny requests if the information is accurate and complete.

Right to Receive An Accounting of Disclosures

You may request an accounting of certain disclosures of your PHI. We may charge a reasonable fee for more than one request in a 12-month period.

Right to Receive A Copy of this Notice

You may obtain a copy of this Notice upon request, either by email or in paper format.

Effective Date and Duration of This Notice

Effective Date

This Notice is effective on June 14, 2024.

Right to Change Terms of this Notice

We may change the terms of this Notice at any time. Changes will be posted on our website. The new terms will be effective for all PHI that we maintain.
